I am suing
News Corp Australia, Nationwide News, The Australian’s CEO, and the
Australian’s correspondents Chris Merritt, Hedley Thomas and Janet
Albrechtsen, for substantial damages,
alleging that they have breached sec 18C of the Racial Discrimination
Act (RDA). My HR Application was filed on 30 Aug 2017 in the Brisbane Federal
Circuit Court: BRG847/2017. Details of the case and Statement of Claim are

The Respondents’ application to dismiss my claim was granted by the Federal circuit-court
on 6 Dec 2018. On 12 Dec 2018 I filed an application to the federal court
for leave to appeal (QUD916/2018) – hearing was on 14 October 2019; decision
reserved. The Issue is do I have a reasonable prospect of successfully
prosecuting my proceeding.
If
I get leave, and then if I prevail at a trial in early 2020, this will be a
blow to The Australian and its cohort, the Institute of Public Affairs (IPA)
of which Albrechtsen is Chairperson, and other 18C haters. Their campaign is
to emasculate sec 18C, making it legal to insult, offend or humiliate a
person belonging to a minority group, like me.
Winning
will have national implications, by clarifying the limits of free speech and empowering the
assertion of human rights by minorities like Cambodians, Indians, Chinese,
Greeks, Jews, Aborigines, Sikhs, Qld African communities, Fiji Australia
Society, Armenians, Macedonians, Buddhist councils, Hellenic council, Arab
and Lebanese councils, Arab/Middle East League, and many others.
An
article in The Australian on 16 Oct 2019, was headed, “Freedom is Not a
Government gift” by the IPA. Obviously timed to come right after my hearing.
The author states that “sec 18C takes away freedom”. Sec 18C haters say free
speech means that one should be free to insult others. The real issue is
about insulting others because of
their race.
Most
western countries have Human Rights laws protecting minorities: See attached re negative things the respondents have said about me, and by
inference, about all minorities. See also attached relevant extracts from
Bolt’s case related to the respondent’s acts.
